In some cases, the Commission can exclude, certain unestablished civil service positions from the requirements of the Public Service Management (Recruitment and Appointments) Act, 2004. If a civil service body thinks that a certain position should be excluded from the Act, it can apply for an excluding order.

Orders are generally only granted for specific short-term initiatives or in exceptional circumstances. For more information on the type of positions an excluding order can be granted for, you can read the Commission's guidance note here.

In order to fill out this form you will need:

  • A letter of sanction from the Department of Public Expenditure and Reform
  • Information on the position that the application relates to
  • A detailed business case outlining the reasons why you believe an excluding order is required
