This section provides information on making requests under the Freedom of Information (FOI) Act. If you do not find the information you need here, please email a request for more information

Under the FOI Act you are entitled to apply for access to information not otherwise publicly available. 

Making an application for information

A request for information should be made in writing and should: 

  • Indicate that it is made under the FOI Act 
  • Provide sufficient information 
  • State any preference you have regarding the format in which the record(s) is/are to be supplied 
  • Provide full personal contact details

Processing an FOI request 
The FOI Act sets down strict time limits for the processing of a request for information. 

  • You should receive an acknowledgement within 2 weeks of the Commission receiving your request 
  • You should receive a reply within 4 weeks of the Commission receiving your request. However, this period may be extended for up to 4 more weeks if: 
    • your request relates to a very large number of records 
    • there has been a large number of requests for the same record(s).

If the period is extended, you should receive notice of this before the end of the initial 4-week period, giving the reason for the delay. 

Procedures if you are unhappy with the Commission’s response 
You may seek an internal review of the initial decision on your request, if: 

  • You are dissatisfied with the response received 
  • You have not received a reply within 4 weeks of your initial application. This is deemed to be a refusal of your request.

A request for internal review must be submitted within 4 weeks of the initial decision. The review must be completed within 3 weeks. An internal review must normally be completed before an appeal is made to the Information Commissioner.

Review by the Information Commissioner 
Following completion of the internal review, you may seek independent review of the decision by the Information Commissioner. You may also seek an independent review if you have not received a response to your application for internal review within 3 weeks as this is deemed to be a refusal.
